Criminal Defense Areas of Law

Criminal Defense Attorney, Kresta Daly, defends federal and state crimes defending many areas of law in federal and state court. Below you will find more information about the different criminal defense areas of law Kresta Daly specializes in:

Federal Crimes

Federal crimes are generally more serious than crimes charged in state courts and the penalties in federal cases are harsh. The consequences of being charged in Federal court are serious. Being the subject or target of a federal criminal investigation or prosecution can be one of the most stressful events in a person’s life. The touchstone of our effort is to be aggressively proactive in implementing strategies to prevent criminal charges from being filed or, failing that, to fight vigorously any charges that may be brought against our clients.

Individuals and businesses who think they are under investigation for a federal crime often contact us before they speak with investigators or receiving a grand jury subpoena. We are often able to prevent the case from becoming public. We are trial lawyers; we relish the courtroom battles and when trial is the only option we zealously defend our clients.

Sex Crimes

No other crime carries the same stigma as sex crime allegations. We understand this and we understand how to defend against sex crime allegations. For nearly two decades defending against sex crime allegations has been a core of Kresta Daly’s practice. People often contact her and her team when they first learn they are being investigated.

Sex crime allegations often come up when there are other legal matters pending. For example, people use sex crime allegations as a sword in divorce cases, child custody battles or in an effort to obtain large financial settlements – sometimes for conduct that never occurred.

In most cases there is no acceptable resolution pre-trial because of the requirement that people convicted of most sex crimes will have to register as a sex offender. This is where we are at our best – in the courtroom battles aggressively defending our clients.

White Collar Crime

Corporations, executives and employees increasingly find their business decisions are the subject of criminal investigations. In the wake of the recession and the collapse of the financial markets criminal enforcement has stepped up in recent years in the areas of mortgages, SEC investigations, securities and finance, antitrust, tax, fraud, embezzlement and Food and Drug Administration regulation. Government prosecutors seek and sometimes obtain harsh penalties such as stiff fines and lengthy incarcerations.

We have unparalleled experience guiding individuals and corporations, large and small, through the treacherous waters of criminal investigations and trials. For nearly two decades, white collar criminal defense has been a core part of our practice. Generally we are contacted at the very beginning of an investigation, before the case becomes public.

Domestic Violence

Domestic violence cases are complex. Regardless of what happened, or didn’t happen, everyone involved is emotionally invested, the accuser and the accused have a history. We have experience successfully unwinding the often long and convoluted issues in domestic violence cases.

In some instances people make domestic violence accusations out of anger or spite, or in order to get the upper hand in divorce proceedings. Sometimes the accusations have some basis in fact but have been distorted by the accuser. In other instances the accusations are valid and they happened because of substance abuse or mental health issues. Whatever the case we know how to get to the core issues, how to ask the tough questions and defend these cases.

Sexual Misconduct Allegations

For nearly 20 years, we have been a “go to” firm for those facing substantial financial liability from claims of sexual misconduct. We have an impressive track record of successfully representing people being sued for claims of sexual misconduct.

We are able to resolve most claims involving sexual misconduct out of court but some do make it to trial. We have extensive experience in state and federal. That trial expertise, coupled with our experience handling civil and criminal matters, gives us a unique advantage. In short, we have achieved extraordinary results for these clients.

When people accused of sexual misconduct turn to us for representation, we appreciate the necessity to act quickly and discreetly to defend them in the court of law and the court of public opinion.

Civil Rights and Civil Liberties

We work tirelessly to protect the innocent and expose the abuses of people who are supposed to protect our society.  Providing legal representation to people who are unable to fight for their own rights is some of the most fulfilling work we do.  We represent individuals in a broad range of civil rights and civil liberties cases from prisoners and parolees suffering from unconstitutional and abusive conditions to citizens being assaulted and mistreated by law enforcement.
