Federal Court Results
- A California federal grand jury indicted a successful business person who was accused of embezzling over $100,000 from their employer. They faced many years in prison. The government recommended a sentence of 41-51 months. Kresta Daly filed a mitigation brief and successfully argued for a sentence of 1 year and one day.
- A man was accused of receipt and distribution of child pornography. He had tens of thousands of images on his computer that he had traded with other individuals for years. The minimum sentence was five years in prison and a maximum of 20 years. After Kresta was retained she discovered the man had developed a severe addiction to pornography during a particularly stressful time in his life. Kresta developed a sentencing mitigation plan for the man which included treatment. The man ultimately plead to a lesser charge and received a substantially lower sentence.
State Court Results
- A woman was accused of attempting to murder her husband after she shot him in the stomach – she was facing 15 years to life in prison. Kresta Daly was retained, conducted a thorough investigation and proved the woman shot her husband was because she was suffering from Battered Woman’s Syndrome caused by her husband’s violent and abusive conduct. After negotiations the woman spent just a few months in county jail.
- A young man from a successful family was accused of breaking into a home, robbing people and using a weapon. He faced being convicted of multple felony strikes and many years in prison. At sentencing the judge dismissed the accusation of breaking into a home over the District Attorney’s objection and the young man was sentenced to time on an ankle bracelet.
